Terms of Service

Campaign Launch ("we", "us", "our") is an AI-powered listing kit generator for Australian real estate agents, operated by an Australian company and accessible at campaignlaunch.com.au. These Terms of Service ("Terms") govern your access to and use of the Campaign Launch platform and any related services (collectively, the "Service").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

We may offer a free trial period at our discretion. During the trial you will have access to some or all features of the Service at no charge for the duration stated at sign-up. No payment method is required to start a free trial unless otherwise specified.

At the end of your trial, access will either convert to a paid subscription (if you have provided payment details and been notified of the conversion) or be suspended until you choose a paid plan. We reserve the right to modify trial terms, length, or availability at any time.

Paid subscriptions are billed on a recurring basis (monthly or annually) as selected at checkout. By subscribing you authorise us to charge your nominated payment method at the start of each billing period.

Subscription fees are stated in Australian dollars (AUD) and are inclusive of any applicable GST unless otherwise stated. You are responsible for all taxes or duties imposed by your jurisdiction in addition to our fees.

You may cancel your subscription at any time through your account settings or by contacting us at hello@campaignlaunch.com.au. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial billing periods unless required by applicable law.

We reserve the right to change pricing at any time. We will provide at least 30 days' notice of any price increase before it takes effect on your subscription.

If you are not satisfied with the Service, you may request a full refund within 30 days of your first payment on a new subscription. Refunds are limited to one per customer and apply to the initial payment only. To request a refund, contact us at hello@campaignlaunch.com.au with your account details and reason for the request.

Refunds are processed within 10 business days of approval and returned to the original payment method. Nothing in this policy limits any rights you may have under the Australian Consumer Law.

You agree not to use the Service to:

• Generate, distribute, or facilitate spam or unsolicited communications;
• Create content that is false, misleading, defamatory, or fraudulent;
• Violate any applicable law, regulation, or code of conduct, including real estate industry regulations in Australia;
• Infringe the intellectual property rights of any third party;
• Attempt to gain unauthorised access to the Service or its underlying infrastructure;
• Scrape, reverse-engineer, or reproduce the Service or its outputs for the purpose of building a competing product;
• Upload or transmit malicious code, viruses, or any content that could harm the Service or other users.

We reserve the right to suspend or terminate your account without notice if we determine, in our sole discretion, that you have violated these Terms.

All content you input into the Service remains yours. You grant us a limited, non-exclusive licence to process your inputs solely to provide the Service.

AI-generated outputs are provided to you for your use. We make no claim of ownership over outputs generated on your behalf. You are responsible for reviewing all outputs before use, including for accuracy, compliance with applicable regulations, and suitability for your intended purpose.

The Campaign Launch name, logo, platform code, and any proprietary content we create remain our intellectual property.

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

AI-generated content may contain inaccuracies or errors. It is your responsibility to review and verify all outputs before publishing or relying on them. We do not warrant that AI outputs will be accurate, complete, or suitable for any particular listing or purpose.

To the maximum extent permitted by applicable law, we and our officers, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of the Service.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim, or AUD $100, whichever is greater.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including the Australian Consumer Law.

We may modify these Terms from time to time. We will notify you of material changes by email or by a prominent notice on the Service. By continuing to use the Service after changes take effect, you accept the revised Terms.

We may also modify, suspend, or discontinue the Service at any time with reasonable notice where practicable.

These Terms are governed by the laws of Queensland, Australia. Any disputes arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
